This unit enables you to study the principles and theory of non-adversarial justice at a high level. You will develop a thorough and sophisticated understanding of the nature of conflict and disputes and will critically examine a number of models of dispute resolution. The unit looks at theoretical and practical issues in relation to dispute resolution that are relevant to working effectively as a professional in a variety of legal and dispute resolution environments. You will have the opportunity to critically reflect on issues such as mediator neutrality, the role of lawyers in dispute resolution processes and the efficacy of confidentiality. These critical reflections will enable you to effectively assess the suitability of dispute resolution processes for certain cases. The unit will also give you an understanding of some of the skills necessary for conflict management and dispute resolution in a variety of contexts.
